Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of thedevs.org and the software development services provided by TheDevs (“we”, “us”). By creating an account or posting a project, you agree to these Terms.

1. Services

TheDevs builds software and technical work that you post, including apps, bots, scripts, websites, landing pages, startup MVPs, browser extensions, DevOps, hosting and domains. Each project is scoped individually based on the brief and budget range you provide. See our Pricing Policy for how quotes and budgets work.

2. Your account

You must provide accurate information when creating an account and are responsible for keeping your credentials secure. You must be at least 16 years old to use the service. You agree not to use the service for unlawful purposes or to infringe the rights of others.

3. Projects and acceptance

When you post a project, we review the brief and confirm scope, timeline, and budget with you in your project chat. Work is delivered in milestones. Each milestone is deemed accepted when you approve it in writing or, in the absence of objection within 7 days of delivery, automatically. You can track progress in your dashboard.

4. Payments

Projects are paid in milestone instalments. Development, infrastructure, and any extra costs are itemized upfront. Milestones already completed and approved are non-refundable; see our Refund & Cancellation Policy for cancellation and refund terms.

5. Intellectual property

On full payment of a project, ownership of the source code and custom assets created for you transfers to you. TheDevs retains the right to use general tools, libraries, and know-how developed independently. We may showcase completed work in our portfolio unless you request otherwise in writing.

6. Confidentiality

We keep your project information confidential and will sign a mutual NDA on request. We expect you to similarly protect any materials we share, including designs and in-progress builds.

7. Warranties

We warrant that delivered work will conform to the agreed milestone scope for 14 days after delivery, during which we will fix defects at no cost. To the maximum extent permitted by law, all other warranties are disclaimed. Third-party services we integrate (hosting, payment processors, app stores) are governed by their own terms.

8. Limitation of liability

To the maximum extent permitted by law, TheDevs is not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or business interruption. Our total liability for any project is limited to the amount you paid us for that project.

9. Termination

Either party may terminate a project per our Refund & Cancellation Policy. We may suspend or terminate your account if you breach these Terms or use the service unlawfully. On termination, provisions that by their nature should survive (IP, liability, governing law) remain in effect.

10. Governing law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Rohtak, Haryana, India.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.
